There are rules that govern the distance a house and other structures can be from the front, rear and side property boundaries - known as setbacks - as well as design (amenity and aesthetics), site coverage (siting) and building heights.

Within Cairns, these are regulated by a combination of Cairns Regional Council’s planning scheme called CairnsPlan, the Queensland Development Code (QDC) and Building Setback Plans.

Do you need Referral Agency Assessment?

A Referral agency assessment is only required for certain types of building works AND only if those works do not comply with the codes and standards for design, siting, amenity or aesthetic provisions.

Apply for Referral Agency Assessment

Preparing a Referral Agency advice request can be a complex task. Unless you understand the legal requirements and Council’s planning rules, you may find it useful to get expert help.

Referral Agency advice can be obtained in two ways:

  1. By a private building certifier as part of a building approvalApplications lodged this way are processed in accordance with strict statutory timeframes. Council will provide the referral agency response to the assessment manager (private building certifier) to include in the building approval decision notice.To apply through a private building certifier, engage your preferred certifier and follow their advice.  Building Certifiers are the assessment managers of development applications for building work and will be able to assist you through the process from beginning to end including referring your application to Council if required.  (Note: if you are engaging a building certifier, they will take care of the application process on your behalf.)
  2. As an early response for advice before applying for building approval
    A property owner can seek an assessment for early response before formally applying for building approval. Early response applications are not subject to specific timeframes for response, and Council has the right to provide a partial or no response.

Referral Agency Advice – for building professionals

Building certifiers, as the assessment manager, are answerable to the client for building approvals and strive to deliver a quick approval for their client. In cases where a Referral Agency response is required, building certifiers - together with Council as the referral agency - are responsible for delivering a positive experience for the customer.
